Terms of Use
Effective October 26, 2026 · Version 1.0
These terms cover your use of every app provided by S2MB Data Management ("S2MB", "we", "us"), the assumed business name (DBA) of Mario Fuller: TIMS (Tracking Information Management System), MET (Marketing Expense Tracker) and ARTS (Asset Retirement Transfer System). You are using ARTS, one of these apps. You accept these terms when you create an account, and again when we ask you to accept an updated version.
Who may use the apps
You must be 18 or older and authorized by S2MB or by the organization you work for. An account is for one person only. New accounts may need an administrator's approval before they can be used.
Your account
- Keep your password and authenticator app private. Don't share your account or let anyone else use it.
- Tell us straight away at support@s2mb.com if you think someone else has used your account or if you see misuse.
- Keep your name and email address up to date.
Acceptable use
- Use each app only for the work you are authorized to do, and look only at the records you need for that work.
- Only enter or upload information and documents that you have the right to share and that are needed for that work.
- Don't try to get around security, access other people's accounts, overload the service, or copy data in bulk by automated means.
- Don't use the apps for anything unlawful.
No professional advice
The S2MB apps are record-keeping and workflow tools. Nothing in them is legal, financial or tax advice. Using TIMS does not create an attorney–client relationship with S2MB.
Suspension
We may suspend or close an account that breaks these terms, puts other users or their information at risk, or is no longer authorized.
Disclaimer and limitation of liability
We work to keep the apps available and accurate, but we provide them "as is," without warranties of any kind, to the extent the law allows. To the fullest extent the law allows, S2MB is not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of any S2MB app. To the fullest extent the law allows, S2MB's total liability for any claim about an S2MB app is limited to the amount you, or the organization you use the app for, paid S2MB for that app in the 12 months before the claim. If a written agreement between S2MB and that organization sets different terms, that agreement applies.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute about these terms or an S2MB app is handled in the state or federal courts located in Denton County, Texas.
Changes to these terms
These terms are shared by all S2MB apps. If we make a material change, we'll post the new version here with a new date and ask you to accept it the next time you sign in to any S2MB app. You can't keep using the apps without accepting the updated terms.
